What You'll Do

In this role, you'll work within the Legal, Privacy & Compliance Team to provide legal and strategic support across the entire company. Reporting to General Counsel, you'll  provide legal knowledge, strategic insights and practical experience to support the Privacy Program, in particular privacy and security requirements under HIPAA and state privacy/security laws. In addition, you'll also:

  • Provide sophisticated legal advice on matters of patient information privacy and security. Particular responsibilities include legal issues facing a business associate supporting covered entity providers under HIPAA, such as business associate agreements and responsibilities, creation of de-identified health information and other secondary uses of protected health information
  • Provide legal counsel to Flatiron Health’s Privacy Officer to support the Privacy Program and respond to privacy, security and data related legal questions
  • Counsel on proposed business arrangements and develop innovative approaches and creative solutions to compliantly enable the business
  • Monitor privacy trends in data protection and privacy laws, regulations and public policy (e.g., evolving guidance out of the European Union, California, etc.)
  • Provide strategic direction to the Flatiron Health organization regarding existing and emerging local and global privacy and data protection laws and trends
  • Provide legal counsel to Information Security and Information Technology (IT) regarding security and privacy legal issues involving systems, and data handling and processing activities 
  • Collaborate with Business Development and other key stakeholders to address data privacy issues with transactions and proposals

You’ll work closely with the General Counsel, Privacy Officer, Chief Information Security Officer and other members of the Legal Privacy & Compliance department to work across the company to identify needs, advise and counsel clients, and support the growth of Flatiron’s business.

Who You Are

You're a resourceful attorney with 7+ years of experience in data protection and privacy that affect the business activities of entities involved in technology for clinical providers, scientific research involving patient-derived data, clinical trials, patient support services. You're excited by the prospect of rolling up your sleeves to tackle meaningful problems each and every day. You’re a kind, passionate and collaborative problem-solver who seeks and gives candid feedback, and values the chance to make an important impact. 

  • You possess substantial experience conducting a legal analysis of and assessing legal responsibilities and risks relating to data protection and privacy, and identifying and advising on practical approaches to compliance and mitigation of risks 
  • You have experience in health care provider and health care research settings including:
    • HIPAA privacy program and data use and protection requirements
    • Research protocol review from the privacy perspective
    • Secondary use of regulated information
    • Experience working with senior-level stakeholders and cross-functional teams, and achieving results through influence and collaboration 
  • You have a comprehensive and sophisticated understanding of relevant statutes, regulations and guidance is required, including state laws governing health information
  • You hold a JD degree and a U.S. state bar membership that is in good standing

  • You have experience with GDPR and other ex-US laws and regulations
  • You hold Privacy and/or Security certifications
