We are seeking a highly autonomous attorney to serve as the legal lead providing guidance on our banking product offered via a BaaS platform through our sponsor bank, as well as money movements occurring on and off the Stash platform.

As the strong subject matter expert you will partner with cross-functional teams and provide legal support for all things payments and consumer banking-related, including advising on federal fund transfer and NACHA rules, fraud operations, and processing relationships.

This requires a strong background in consumer payments and the parties, technology, and operations involved, familiarity with BaaS platforms and expertise with all laws and regulations relating to consumer payments, both federal and state.

What you'll do:

• Serve as the legal lead for all things payments and consumer banking-related, including advising on federal fund transfer and NACHA rules, fraud operations, and processing relationships;
• Negotiate commercial contracts supporting our banking product;
• Advise on any new products or features of our digital banking platform to ensure compliance with applicable law; and
• Draft and maintain consumer-facing terms of use and disclosures.

What we're looking for:

• JD and licensed to practice in New York, or the ability to apply for New York's in-house counsel exemption
• 10+ years of experience, with 5-8+ years in-house; specifically in consumer payments and the parties, technology, and operations involved
• Familiarity with BaaS platforms
• Federal and state consumer regulations; Reg E, Reg CC, and NACHA; Gramm Leach Bliley and state privacy laws including CCPA; card and network rules
• Basic understanding of legal issues involving marketing/advertising of a consumer banking product, including UDAAP and TCPA and other consumer protection laws
• A proven ability to successfully execute against strategy in tandem with non-legal functions
• A team player who is willing to assist at any level of legal work that is needed to be done
• Ability to manage competing projects autonomously
• Excellent written and oral communication skills and an ability to convey complex legal advice to business people
