About the Role

We are looking for a bright and motivated Senior Counsel, Litigation & Regulatory to join our legal team. As Senior Counsel, you will play a key role in the company’s risk mitigation processes, working on legal and regulatory initiatives involving cutting-edge products. Top candidates will understand relevant legal issues and have the drive and creativity to implement best-in-class processes to advance our business. You will help manage litigation on behalf of the company while collaborating on a wide range of regulatory, privacy and data protection, consumer protection, and other legal issues that shape MoneyLion. We are a growing legal team at a newly public company and are looking for someone who proactively takes on new responsibilities, enjoys wearing multiple hats and is excited by the challenge of providing legal services at a dynamic, fast-growing fintech company.
Key Responsibilities

  1. Litigation
    • Handle a wide range of pre-litigation, litigation, and other disputes involving consumers, regulators, employees, vendors, competitors and other parties.
    • Manage outside litigation counsel in a cost-effective manner while developing company-wide litigation strategy and building litigation management functions.
    • Coordinate internal fact gathering and discovery processes.
    • Work with the Finance team on setting reserves, creating litigation budgets and meeting litigation reporting requirements.
    • Identify and escalate potential litigation issues, provide root cause analyses, and advise key stakeholders accordingly.
    • Conducting complex and nuanced legal research, as necessary.
    • Handle subpoena responses and help enhance subpoena compliance processes.

  2. Regulatory
    • Provide regulatory advice on proposed business initiatives, financial products, disclosures and licensing, and assist in implementation of new product/service initiatives.
    • Calculate probable legal risks and regulatory requirements for new products, solutions and technologies.
    • Monitor and interpret laws, rulings and regulations involving the company’s business lines, including consumer banking, lending, investing and payments.
    • Respond to regulatory inquiries and handle regulatory investigations.
    • Collaborate with the Compliance Department on a wide range of regulatory compliance initiatives.
  • Ad-Hoc
    • Advise on the potential for litigation or regulatory issues arising from critical contracts, marketing collateral and advertisements.
    • May be called on to provide support for contract overflow and data privacy initiatives.
    • Handle miscellaneous legal projects, as needed.
  • About You

    •  J.D. degree
    • 3 to 7+ years practicing law. A mix of law firm and in-house counsel experience is preferred.
    • Experience litigating matters at a commercial law firm with additional experience managing litigation or regulatory matters as in-house counsel at a financial services company, fintech or a U.S. government agency is a plus.
    • Financial services background preferred. Technology experience is a plus.
    • Strong knowledge of consumer protection laws, particularly as they relate to the financial services industry, and related procedures. Well versed in state and federal regulations that may impact our business, including without limitation the FCRA, ECOA/Reg B, Reg E, UDAAP, GLBA, Dodd-Frank and state level consumer protection laws.
    • Experience providing legal counsel for the development and launch of financial consumer-facing products or services.
    • Sharp analytical and communication skills, diligent, proactive, and collaborative, and have demonstrated excellent legal and business judgment and strategic thinking.
    • Comfortable in dynamic, fast-paced environments, with an entrepreneurial spirit and willingness to roll up your sleeves and do the work.
    • Strong problem-solving and decision-making skills that allow you to make clear, pragmatic legal recommendations into actionable guidance that aligns with the goals in our fintech ecosystem.
