Consumer Class Action Litigation Associate

MB Attorney Search is conducting a confidential retained search for a Litigation Attorney to join the growing class action practice of a well-established plaintiff-side litigation boutique. This role offers an unusual opportunity for a strong litigator to take meaningful ownership of sophisticated nationwide matters, mainly focused on data breach cases, and develop toward independently managing cases.

The firm is particularly interested in attorneys with 4+ years of substantive litigation experience. Experience with data breach, privacy, consumer, or class action litigation is highly valued, but direct data breach experience is not required. The firm is willing to train an accomplished litigator who brings strong writing skills, sound judgment, initiative, and meaningful case-management experience.

This opportunity is particularly well suited for an attorney who is ready for greater responsibility. The incoming associate will work closely with an experienced partner on a growing portfolio of data breach class actions, with the opportunity to take increasing ownership of matters as capabilities develop. The firm is looking for someone who anticipates what needs to happen next, takes initiative, follows through, and wants to develop into a lawyer capable of independently managing cases.

Responsibilities

  • Handle sophisticated consumer class action litigation, with a primary focus on data breach matters.

  • Investigate and develop potential cases and claims.

  • Draft complaints, substantive motions, briefs, settlement papers, and other written advocacy.

  • Manage litigation deadlines and help develop case strategy.

  • Communicate directly with clients and work closely with co-counsel.

  • Participate in court appearances, arguments, settlement negotiations, and mediations.

  • Coordinate with paralegals, staff, vendors, experts, and other members of the litigation team.

  • Take increasing responsibility for managing matters independently as experience and capabilities develop.

  • Contribute to case development and, over time, have opportunities to develop original matters and areas of practice.

Qualifications

  • Approximately 4–8 years of substantive litigation experience preferred. Exceptional candidates outside that range may also be considered.

  • Strong legal research, analytical, and writing skills.

  • Meaningful experience managing litigation matters or substantial components of cases.

  • Demonstrated initiative and ability to anticipate deadlines, identify next steps, and move matters forward without requiring constant direction.

  • Experience drafting substantive motions, briefs, pleadings, or other significant written advocacy.

  • Sound professional judgment and strong organizational skills.

  • Direct data breach, privacy litigation, consumer class action, or other class action experience is highly valued.

  • Attorneys with backgrounds in complex commercial litigation or other sophisticated civil litigation may also be considered.

  • Plaintiff-side experience is welcome but not required. Attorneys currently practicing on the defense side who are genuinely interested in transitioning to plaintiff-side litigation are encouraged to apply.

  • Admission to practice law in at least one U.S. jurisdiction required.

  • Wisconsin admission is a plus.

  • Opportunity to develop as a complete litigator. Rather than limiting associates to narrow pieces of larger matters, the firm wants attorneys to develop the judgment and experience necessary to run cases themselves.

  • Realistic advancement opportunities. The firm has a demonstrated history of developing associates into partners. Every current equity partner began at the firm as an associate, and advancement is based on development, performance, and contribution rather than a rigid timetable.

  • Opportunity to develop business and originate cases.Attorneys are encouraged to identify potential cases and develop their own ideas and relationships. The firm maintains a formal origination compensation program for attorneys who generate qualifying matters.

  • Collaborative small-firm environment.The firm combines significant litigation with a smaller, team-oriented platform where associates have direct access to partners and strong performers are given meaningful autonomy.

  • Remote flexibility. The firm is open to attorneys outside Chicago and currently supports fully remote attorneys in other states.

Compensation

Base compensation begins at approximately $150,000+, depending on experience, qualifications, and overall fit. The firm does not use a rigid lockstep compensation model and is willing to consider higher compensation for an exceptional candidate.

Associate billable hour requirement is 1800 hours to be eligible for consideration for a year-end discretionary bonus. Bonus decisions take into account not only hours, but also the quality and value of the attorney's work, performance, follow-through, and overall contribution.

Location

The firm is based in Chicago, Illinois.

Fully remote or hybrid arrangements are available, provided working hours can maintain meaningful overlap with Central Time business hours.

Occasional travel may be required for court appearances, hearings, or other case-related needs.
