Hours: Full-Time – 35 Hours

The New York City Department of Design and Construction (“DDC”) serves as the City's primary capital construction project manager that delivers the construction and renovation of civic facilities and infrastructure for the City of New York. Working with partner agencies, architects, contractors and consultants, DDC builds and renovates public facilities and advances roadway, sewer, water main, and streetscape projects across all five boroughs. To aid in this important civic mission, DDC’s Law Division serves as in-house counsel for the agency and is seeking a highly motivated attorney interested in developing a career in public service with an emphasis on transactional law and public procurement. Under supervision with some latitude for independent judgement and action, the selected candidate will provide legal support across a broad range of matters, including contract drafting and review; procurement, construction, insurance, environmental, and employment law; litigation support and claims analysis; Freedom of Information Law (“FOIL”) requests; conflicts of interest reviews; grant preparation; real estate and land use matters; funding and security agreements; labor and employee relations issues; and legal research and opinion drafting on a wide variety of matters as in-house counsel.
The Assistant General Counsel will be expected to conduct various types of legal work as in-house counsels, including but not limited to: 1) review and revise professional, construction, and design-build contract documents and communicate contract approval and public procurement requirements to the agency’s construction and design divisions; 2) perform litigation support activities and commercial claims analysis for matters pending with the NYC Law Department and the NYC Comptroller’s Office; 3) review agency responses to the public pursuant to the Freedom of Information Law (“FOIL”) and coordinate agency responses to the public in coordination with the agency’s public relations office; 4) evaluate and provide legal guidance on conflicts of interest related matters to agency staff and management; 5) assist with the review of real property issues that impact the agency’s construction efforts, including the oversight of real property condemnation proceedings pursuant to the New York State (NYS) Eminent Domain Procedure Law (“EDPL”), the review of various types of leases, title reports, surveys, as well as the review and preparation of various types of license agreements and land use actions; 6) prepare funding and security agreements for the Office of Management and Budget (“OMB”) review and approval, and ensure the City’s first-priority security lien interests pursuant to the Uniform Commercial Code (“UCC”); 7) assist division staff with procurement appeals and decision process, including draft opinions and presenting facts and decisions to the Agency Chief Contracting Officer and agency staff; 8) assist Director of Labor Relations, Human Resources, and others on issues pertaining agency employees, locals representing employees, grievances, and any other issues that arise regarding the collective bargaining agreement; and 12) research for the recommendation and interpretation of various laws, rules, and regulations.
The Agency Attorney, level 1, will also assist DDC’s Law Division with other assignments and projects, as needed, which may include matters that may relate to a wide array of topics, such as: public procurement, contract law, construction, property-related issues, FOIL appeals, secured transactions / UCC, environmental law, eminent domain, commercial leases, insurance issues, access agreements, conflicts of interest, equal employment, and employment law. The Agency Attorney, level 1, will also need to routinely track and report their work to DDC Law management.
Please note: All candidates must be currently authorized to work full-time in the United States (U.S.). Qualifications

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
