Role Summary

This is a senior-level claims and litigation management role focused specifically on Employment Practices Liability (EPL) within a healthcare-related environment. The person in this role will own assigned EPL claims end-to-end — determining coverage, investigating allegations, assessing liability and financial exposure, directing defense counsel, negotiating settlements, and reporting significant claims and risk trends to senior leadership.

This is not a general HR or general claims processing position. It requires someone who has directly handled EPL matters (as a claims professional or as an attorney defending employers) and who understands the full lifecycle of a legal claim, from initial investigation through litigation and resolution.

Key Responsibilities

  • Manage assigned EPL claims from initial investigation through final resolution
  • Analyze and determine whether claims are covered, identifying any coverage issues
  • Investigate allegations by interviewing/corresponding with attorneys, employees, witnesses, and business stakeholders
  • Assess potential legal and financial exposure for the organization
  • Work with and direct defense counsel on litigation strategy and activities
  • Negotiate settlements and claim resolutions with defense counsel, plaintiff attorneys, and stakeholders
  • Determine when claims should be denied, settled, or otherwise resolved
  • Report significant claims, exposure, and trends to senior leadership with recommendations
  • Coordinate referrals and updates with reinsurers
  • Monitor and attend (as needed) cases proceeding to mediation, arbitration, or trial
  • Identify risk trends and recommend strategies to reduce future loss exposure

Requirements
  • 10+ years of experience in Employment Law, Risk Management, Insurance, or related Employment Practices Liability work
  • Direct experience handling EPL claims as a claims professional, or defending EPL claims as an attorney
  • Strong understanding of the claims/litigation lifecycle: investigation, coverage, liability assessment, litigation, negotiation, and resolution
  • Strong negotiation skills with defense counsel, plaintiff attorneys, business stakeholders, and insurance/reinsurance parties
  • Strong legal/risk judgment in evaluating liability likelihood and potential financial exposure
  • Bachelor's degree
  • Experience managing or directing outside defense counsel in employment-related litigation
  • Experience presenting significant claims, exposure, or trends to executive leadership
  • Experience in a healthcare organization (preferred)
  • Experience handling management liability claims such as D&O or professional liability alongside EPL (preferred)
